What are the legal requirements to get married in India?
Getting legally married in India is a lengthy and time consuming process, and you should allow to spend around 60 days in the country. As a result, many people prefer to take care of the legal part of the wedding at home and just have the wedding ceremony in India.
Legal age for marriage is 18 years for both men and women
Bride and Groom may not be related by blood, marriage or adoption.
There are 3 marriage acts, Hindu, Christian and Special (for mixed faith marriages)
Three witnesses are required, who have to provide passport sized photographs, as well as identification and proof of address are required for a registrar wedding.
The marriage certificate is usually issued a couple of weeks after the wedding.
How long do I have to be resident in India before I can get married?
Special Licence marriage – The Special Marriage Act (1954): File the papers below with the marriage registrar. A notice of intent to marry is then posted for 30 days, after which the marriage can take place. This is evidenced by a certificate from the local police station. It can be either the bride or groom.
Hindu marriage: you must both be Hindu to marry under this act.
Christian marriage: you must both be Christian to marry under this act. If a minister marries you you must notify them in writing of your intent to marry, then a notice of intent to marry (banns) is posted for 3 consecutive Sundays before the wedding takes place.
If a registrar marries you the marriage notice will be posted in the registrar’s office for one month before the ceremony – submit your intention to get married to the registry office

Two passport sized photographs of each
Single Status Affidavits (if from USA) or Certificate of No Impediment (if you are from UK) required stating you are both single and free to marry from your Embassy.
If you have been divorced then you’ll need to produce the Decree Absolute divorce papers.
If you are widowed then the death certificate of your previous spouse must be shown.
Certificates from the local police station that you have both lived in the area for at least 30 days.
Getting legally married in Goa (different)
Unfortunately, the legal process for foreigners getting married in Goa, which has its own Civil Code, is an even lengthier process. There’s a 30 day residency requirement for both the bride and groom, who will need to obtain a residence certificate from the local municipality. In order to get married, the couple (along with four witnesses) must apply before a Goan court, which will grant a provisional wedding certificate allowing the marriage to go ahead.
This certificate is taken to the Civil Registrar, who’ll affix a Public Notice inviting objections within 10 days. If none are received, you can then get married. If you’re leaving Goa before the 10 days expire, it’s possible to get the period waived by applying to the Assistant Public Prosecutor. This will enable you to get married right away.
For a Catholic church wedding in Goa, the bride and groom will need to obtain a “No Objection” certificate from their Parish priest acknowledging the wedding and giving permission to get married in a church in Goa. Baptism certificates, confirmation certificates, and a letter of intent will also need to be provided. In addition, it’s necessary to attend a wedding course, either in your own country or in Goa.
